Adoptables & Designs
- All design work (adoptables and custom designs) made by me are for personal use only.
- Adoptables are purchased designs that you can use to make your own character. You may name the character, choose a gender, create a personality and any background information for the character, as well as make minor design changes within specified restrictions (see below). You may choose to use your adoptable outside the official lore, but you must follow rarity guidelines regarding appearance changes.
- You may not claim the original artwork or species as your own (unless in the case of a custom commissioned of your own species), and you may not set it up for redistribution in commercial third-party projects.
- I retain partial rights to the design. This includes all copyrights, rights to the intellectual property, the rights to distribute, reproduce, and use in my online galleries and portfolio. I will not resell or reuse the design again for personal or commercial projects, unless the design has been sold/traded back to me or has been reclaimed due to a specific TOS violation regarding chargebacks.
- You own partial rights of the design, of which are the qualities and personality you have created for the character.
- You may upload the design artwork to other sites so long as it is credited and linked back to any of my galleries.
- I likely won't be going out of my way to enforce this, but please watermark and/or resize your full sized images before posting them publicly. This is to help prevent theft of the design and protects from a lot of potential trouble in the long run. When trading designs within my closed species, please remember to refer to the species masterlist (dracompendium) to see who the current official owner is.
- Co-ownership is not officially recognized by the masterlist, and only one person can hold official ownership per design. While I will not enforce a "no co-ownership" rule, I will not intervene in potential arguments over the custody of affected designs if issues arise later. Co-own at your own discretion.
- I will not reclaim designs that have been fully paid for, even from those who later have become blacklisted.
- Only in the case of a chargeback will I reclaim and keep/resell any affected design(s). Failure to rectify the situation will result in blacklisting, as well as a publicized PSA of the situation so that others are informed of you as a potential source of future chargebacks.
Design Editing
- Any design changes are to be approved by me before public posting or use. Most changes (color shifts, marking edits, etc.) should be approved so long as the original design is still recognizable, and does not add any extra rarity values to the adoptable (if a closed species).
- I'm not particularly fussy about edits (and I would encourage it if it helps you connect to and enjoy a design) so I wouldn't worry about changing "too much" as long as it retains aspects that are recognizable from the original design. I wouldn't think badly of anyone wishing to edit my designs, so there is no need to avoid inquiring about them.
- I allow any design edits to be made directly onto my original artwork. Please note that all edits will be compared to the original design to determine whether they will be too drastic or not. Please be aware guest designs or collaborated designs may have different terms regarding directly editing artwork, so please review their sales post or masterlist entry beforehand.
- Changes that do not have to be run through with me are edits to gender, body type, hair style, and outfit additions.
- You may change the species of and make alternate forms for designs made by me, but all derivatives must be included with the original design when selling or trading as they are all still considered the same design.
- Changing my designs to a different closed species requires permission from the corresponding species owner, please check with both me and the owner of the CS you are interested in before doing so.
- I have the right to decline any changes without a specified reason.
Resales / Trades
- All closed species adoptables are kept in a public registry to verify legitimacy of ownership. Please double check with this before trading to ensure safety of the trade. (Located here: @dracompendium)
- You may sell, trade, or gift designs purchased from me, unless a rule in its corresponding listing (deviation, journal, etc.) states otherwise.
- Any trade restrictions will be listed in the design's masterlist entry.
- You must inform me of any selling, trading, or gifting of my designs and MYO slots of my species, so that I can confirm the new owner isn't blacklisted from my species or sales, and to update the registry as needed.
- The new owner must be linked to my TOS so that they are aware of and agree to the terms attached to the design.
- My TOS takes precedence over other users' with my species and designs, unless an exception is specified on a design's masterlist entry.
- You may change the species of designs made by me, but all derivatives must be included with the original design when selling or trading as they are all still considered the same design.
- For designs of my species made into or as an alternate form of an already existing character, please ask me beforehand if the designs are considerably different enough to transfer separately.
- You may sell a design by me or a design of my species (one exception listed in MYO rules below) for more than what was paid. You may sell a design that was traded for.
- Not exactly a set rule, but selling/trading designs that are gifted to you without permission given from the gifter is not advised. I will neither intervene nor take responsibility for any consequences, social or otherwise, resulting from doing so.
MYO Rules
- MYO designs must follow the set rules of each species, and stay within any corresponding rarity limitations specified beforehand.
- The design must be approved by me before it is confirmed to be official, through notes. Please do not post your design publicly before said approval.
- Any changes after being made official will have to follow the design edit rule listed above in the Adoptables & Designs section.
- Do not trace or heavily reference others' artwork for your MYO, and do not copy or heavily reference a preexisting design. If there are too many similarities to an existing design, you will be asked to revise it.
- I will require permission to take a small thumbnail (250x250px) of your finished MYO's original design artwork to post solely for registry purposes. The thumbnail will be watermarked before being uploaded to the registry, whether one will be provided by yourself or be the default :devdracompendium: watermark. Your original design post will be linked back (under Source) in the registry description if you posted it publicly.
- Trading, selling, or gifting your MYO ticket/slot or design is perfectly fine (within above Resales & Trades rules). Please inform me of any MYO ticket/design trading so that I can keep the masterlist updated.
- You may commission another artist to design your MYO slot for you. Please make sure their TOS doesn't conflict with my own beforehand though, since I will be contacting the artist(s) to confirm.
- When commissioning another artist to make your MYO design, you are required to respect their own trade/resell rules regarding their designs. For example, if an artist does not permit their designs to be sold for more than what it was paid for, it takes precedence over my own trade/resale restrictions. Any designs with this following this restriction will be marked in its corresponding masterlist entry.
- Unless otherwise specified in the corresponding listing/post, there is no deadline to complete your MYO design. Take as much time as you need!
- I do not offer exchanges or "trade-ins" of MYO slot(s) to count towards commissions or other purchases if you no longer desire to keep the slot, as this is considered a form of refund.
